Please ensure you read the terms and conditions of Memberships, in particular with regards to no-shows, cancellations and non-payment of fees.

By purchasing any Nimaya Membership subscription you are accepting in full the terms and conditions set our below.

 

NIMAYA MINDSTATION LTD - GENERAL TERMS & CONDITIONS

1. GENERAL

Nimaya MindStation Limited (“Nimaya”/”we”/”our”) aims to provide useful, holistic and other healing therapies, assisting those with physical and mental ailments as a complementary lifestyle service but without any intention of replacing conventional medical advice or treatment which, when in doubt should be sought and must not be ignored by you. You must make your own research on the Services that we provide and when in any doubt you must seek medical advice from your GP or other relevant medical practitioner before using any of our Services.

2. DESCRIPTION OF SERVICES

By way of example the “Services” include, but are not limited to:

  • Floatation tanks 

  • Cryotherapy

  • Full Spectrum Red Light Sauna with Chromotherapy 

  • Photobiomodulation Bed (Advanced Red-Light Therapy)

  • Hyperbaric Oxygen Chamber

  • Pandora light therapy 

  • Japanese Integrated Medicine

  • Craniosacral therapy

  • CBD massage therapy

3. ACCEPTANCE OF TERMS AND CONDITIONS

It is a condition of accessing and using this website and our Services that you understand, acknowledge and agree to comply with these Terms and our Privacy Policy (your agreement). Nimaya may change its Website and/or the Terms, including cancelling the Services, so you should check the Terms from time to time for any changes. If you do not agree to these Terms you must immediately terminate your agreement and cease to access this website or purchase or use the Services we offer. Nimaya is committed to a world without violence, including verbal and physical. We believe that everyone has a right to live without abuse. Clients/Customers/Members who engage in any abusive or threatening language or activity may have their access restricted to our premises and use of our Service at any time, without notice.

4. PRIVACY POLICY

Any information collected and used by Nimaya is used as set out in a Privacy Policy and you hereby agree to accept those terms as if they were a part of these.

5. INTELLECTUAL PROPERTY

Copyright in the Nimaya website is property of Nimaya. This property may only be used for the purposes of browsing the Nimaya.co.uk website and acquiring goods and services of Nimaya. You may not re-produce or disseminate or share any information received during your use of our website and Services without the approval of Nimaya.

6. PURCHASING SERVICES

If you purchase Services from Nimaya through this website, third party websites, portals or otherwise, we may require you to provide your name, address, email address or other details (“customer information”). We may subsequently require further details to enable the processing of any orders/purchases that you make or prior to your use of our Services at our premises. You agree to provide Nimaya with current, complete and accurate customer information when asked to do so.  All care is taken to ensure that the Nimaya website and data transmissions are free from viruses. However, it is your responsibility to scan any data or websites for viruses. The purchase of goods and Services is restricted to individuals of 18 years of age or older. Individuals under the age of 18 may have purchases made on their behalf by a parent or guardian or with express consent. Nimaya may non-the less not offer certain specific Services to persons under the age of 18 in which case we will provide you with a full refund. If in doubt, please contact us for further clarification prior to making a booking for one of our Services. Using our website provides you with a safe method of ordering. Your payment details will be verified and authorised when you place your order. Your payment may be debited from your account before we supply services.

 

Please note that payment may be processed via a third party payment system, such as a third party payment gateway, in which case you will be making the purchase and sharing your details with such a provider and it will be done subject to their terms and conditions of trade and their privacy policy.

7. VITAMIN INJECTIONS - TERMS AND CONDITIONS

a) Online Bookings are designed mainly for existing clients who have already undertaken at least one consultation & subsequent treatment with us.

b) Any purchases from new customers will require them to fill in a secured online Medical Questionnaire and attend a first consultation in advance of any treatment being undertaken.

c) The suitability of pre-purchased courses for all new clients is at our practitioners’ discretion. An alternative course may be recommended.

d) Existing clients may need to refill their Medical Questionnaire, at our practitioners’ discretion.

e) All treatment slots must be booked in advanced; no walk-ins permitted.

8. BOOKING CHANGES, NO SHOWS & CANCELLATIONS

These booking terms and conditions apply to individual bookings as well those booked as part of a membership and/or package. No exceptions will be made.

Late Attendance - Customers late for an appointment may have their session shortened.

Re-scheduling - Customers may re-schedule any appointment online up to 48 hours in advance. Thereafter appointments can only be re-scheduled by calling the centre on 0208 103 0212 and will only be allowed at the discretion of the management. If it is not possible to reschedule the appointment as a result of the customer, no refund will be given and the full payment for the appointment will be charged.

No Shows - Payment will be charged in full for any missed appointments, unless it has been agreed in advance by the management to reschedule or cancel the appointment.

Cancellations - Cancellations are not allowed except for in exceptional circumstances and only if expressly agreed by the management. A cancellation request must be made in advance by phone only and with 48 hours notice. If the management decides not to cancel the appointment, no refund will be given and the full payment for the appointment will be charged

Payment - All sessions must be paid in advance via any payment system we have available at the time, including but not limited to, the website, a payment gateway system, or in full through bank transfer. All such payments will be made subject to the payment system provider’s terms and conditions and privacy policy.

Suspension - any charges incurred for no-shows and cancellations will be applied to your Nimaya client account, including those with memberships, and no further treatments will be able to be booked until all outstanding monies have been paid. 

9. RIGHT OF REFUSAL OF SERVICES

Nimaya reserves the right to refuse service to any customer at its sole discretion. This may be for reasons of unsuitability to benefit from the Services or for reasons of misconduct, abusive behaviour or for medical reasons that may make the provision of such Services to be deemed unsuitable.

10. LIABILITY WAIVER

Nimaya will not be liable for any damages, loss or injury that accompany or result from your use of the Services or any material on this website. All our Services are offered as lifestyle complementary Services and are never intended to replace Medical advice and you are urged to make your own research about our Services and when in doubt seek medical advice from your GP before purchasing or using any of the Services available at Nimaya.  All the information on our Website about each Service is provided as general information and is not intended to offer medical information or advice, nor is it intended to make any claims as to its medical benefits or otherwise. You must make your own research about each Service and use such Services at your own discretion and when in doubt consult a relevant professional for professional matters such as medical, legal, financial, psychological and otherwise. No warranties are given or implied by this membership agreement.

11. DISCLAIMER

To the fullest extent permitted by applicable law, Nimaya disclaims all representations and warranties, express or implied, including but not limited to, medical advice, implied warranties of merchantability and fitness for a particular purpose. Nimaya makes no warranty that the Services provided will meet your requirements.

You further acknowledge and agree that Nimaya will not be liable to you or any other person for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for medical liability or negligence, product liability, personal injury or negligence resulting from the use of Services supplied to you, or on behalf of you, through this website, at our premises or elsewhere where are Services are provided. 

You must not rely on the information on this website as an alternative to medical advice from your doctor or other professional healthcare provider.  If you have any specific questions about any medical matter you should consult your doctor or other relevant professional healthcare provider.  If you think you may be suffering from any medical condition you should seek immediate medical attention.  You should never delay seeking medical advice, disregard medical advice, or discontinue medical treatment because of information on this website or when using any of the Services offered by Nimaya.

If you require advice relating to a particular health problem, Nimaya strongly urges you to contact your doctor or other medical practitioner.

Nimaya and the operator(s) of this site and any service providers at our place of business specifically disclaim all responsibility for any liability, loss or risk, personal or otherwise, which is incurred as a consequence, directly or indirectly, of the use and application of any of the material on this site or of your use of the Services we provide on our premises. When is doubt you must seek the advice of your general medical practitioners.

12. INDEMNITY

You will indemnify Nimaya, against any legal action including claims, demands, damages, responsibility, costs or expenses including legal fees that may be incurred due to your using our Website, Services or any information published on our Website.

13. GOVERNING LAW

These terms are governed by the laws of England and Wales and you agree to follow these rules and laws. Even if an English court agrees that some part of this Agreement is not valid, the rest of the Agreement will remain valid.

By using the online booking form or system you agree to the above terms and conditions. You understand that all sales are final and if you need to reschedule the session time you must do so 24 hours prior to the session time. You understand that cancellation and missed appointments for any reason within 24 hours of appointment time forfeits the session time and money paid.

MEMBERSHIPS - TERMS & CONDITIONS

UNLIMITED MEMBERSHIP

Nimaya Mindstation is a business Nimaya Mindstation Ltd. Except where expressly agreed otherwise by us in writing every Member shall be subject to these terms and conditions. Nimaya Mindstation Ltd reserves the right to use discretion in all matters relating to membership.

 

  • Members must be 18 years of age or over to be accepted for a Nimaya Unlimited Membership.

  • Members may book any number of the specified treatments detailed in the Unlimited Membership pack/Memberships page on our website.

  • Members receive 10% discount on specified Holistic therapies and will be issued with a unique discount code upon joining. This code must be used at the time of booking for the discount to apply. This unique discount code must not be given to or used by anyone except the Member.

  • Membership is individual and cannot be shared.

  • An Unlimited Member joins on a 3-month minimum rolling contract. Membership begins on the date of your first payment or a later date of your choosing, and payment will be taken each month on the same date as the start of your membership.

  • Membership will be charged at the advertised rate monthly in advance by credit/debit card when they purchase the Unlimited membership and then monthly recurring on an auto-renewing basis. Non-payment of any fees will result in use of the facilities being suspended until payment is made. Any part of the 3-month contract which is unpaid, due to monthly renewal payments failing to be made will be invoiced directly to the Member and immediate payment will be required. 

  • Any unpaid membership fees will attract an administration charge of 25% on the outstanding balance, and this will be charged for on a weekly basis. The admin fees will be added to the Members outstanding balance and will be included when calculating the additional weekly charges.

  • No refund will be given for any part-used membership fee.

  • Members must wear the correct equipment provided to them where necessary for the particular treatment they are undergoing. Nimaya Mindstation will not be liable for any injury or damage caused by members not adhering to this.

  • Nimaya Unlimited Members will be notified by email of any changes to subscription fees; the website will detail other changes. Terms and conditions of membership may be revised from time to time and members should be aware of the terms and conditions posted on the website. (last revision January 2021)

  • Nimaya Mindstation endeavours to provide the treatment facilities in the best condition possible. This may, from time to time, result in closure of the facility to make improvements considered to be in the best long-term interest.

  • Limitations of Liability. The member acknowledges that the Club’s obligations and liabilities in respect of the Facility are exhaustively defined in this agreement. The Club accepts no responsibility for any loss or damage to members or their personal belongings whilst using the Facility.

  • These Terms & Conditions are the latest available and those that are currently in force. Nimaya Mindstation Ltd reserves the right, at any time, to modify, alter, or update these Terms and Conditions, and you agree to be bound by such modifications, alterations, or updates. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by any means including, but not limited to posting on the website at www.nimaya.co, or by electronic or conventional mail.

CORPORATE MEMBERSHIP

Nimaya Mindstation is a business Nimaya Mindstation Ltd. Except where expressly agreed otherwise by us in writing every Member shall be subject to these terms and conditions. Nimaya Mindstation Ltd reserves the right to use discretion in all matters relating to membership.

 

  • Corporate Members employees must be 18 years of age or over to have a treatment at Nimaya Mindstation

  • Members may book any number up to the maximum allowed in your agreed membership of the specified treatments detailed in the Membership pack/Memberships page on our website.

  • Members receive 10% discount on specified Holistic therapies and will be issued with a unique discount code upon joining. This code must be used at the time of booking for the discount to apply. This unique discount code must not be given to or used by anyone except the Member.

  • Membership is for the use by employees of the named Member company only and cannot be shared.

  • A Corporate Member joins on a 6-month minimum rolling contract. Membership begins on the date of your first payment or a later date of your choosing, and payment will be taken each month on the same date as the start of your membership.

  • Membership will be charged at the advertised rate monthly in advance by credit/debit card when they purchase the Corporate membership and then monthly recurring on an auto-renewing basis. Non-payment of any fees will result in use of the facilities being suspended until payment is made. Any part of the 6-month contract which is unpaid, due to monthly renewal payments failing to be made will be invoiced directly to the Member and immediate payment will be required.
